Virginia requires an entry permit before bringing bees on comb, used combs, used hives or other used apiary appliances into the Commonwealth. The Virginia Bee Law also covers certificates for incoming combless packages and sales of specified bee stock and equipment.

Contact VDACS’s apiary inspection program before arranging delivery or advertising a sale. Give the origin, contents, destination and dates, then verify the local parcel requirements through the address-level legal checklist.

Match the Document to the Activity

ActivityOfficial requirementPlanning step
Incoming bees on comb or covered used appliancesEntry permit under section 3.2-4405Obtain the issued permit before arrival
Incoming combless packages, including queensOrigin-official health certificate under section 3.2-4406Confirm the certificate travels with the shipment
Offering covered bees, hives or equipment for saleItem-specific health certificate with the bill of sale under section 3.2-4407Arrange inspection before offering the items
Using someone else’s land for an apiaryConspicuous owner or operator name and address under section 3.2-4411.1Prepare identification and landowner permission

Section 3.2-4405 requires specifically identifiable colonies to enter within 60 days after permit issuance. This is a permit-to-entry window, rather than a claim that every origin inspection certificate has a 60-day lifespan.

Prepare an Accurate Import Application

The VDACS entry application asks about origin, purpose, equipment types, counts and anticipated entry. It provides space for the actual destination when that differs from the applicant’s address.

List a nucleus hive as a purchase containing comb. For used equipment, distinguish boxes with frames from individual frames and describe their history. Keep the purchase quote consistent with what the agency reviewed; if the load changes, check the documents again.

Agree with the supplier who will coordinate the origin inspection and receiving-state permit. Save the issued documents with the invoice and colony identifiers. A submitted application is a step toward approval, not proof that a permit was issued.

Inspectable Hives and Disease Reporting

Section 3.2-4403 generally requires movable frames, subject to its limited initial-period provision. Section 3.2-4404 requires immediate notice to the State Apiarist when a person is aware of diseased bees, including the exact location.

Keep a yard map and inspection notes so you can describe the relevant colony without guessing. Seek qualified assessment for suspicious brood and hold suspect comb separate while obtaining advice. Review our American foulbrood guide before sharing equipment from an unexplained loss.

For breeding or rearing bees for sale, ask VDACS about the additional inspection duties in section 3.2-4408. Classify that activity before investing in a sales season.

BeeCheck and Property Permission

VDACS describes BeeCheck as a free, voluntary apiary map for communication among keepers, agricultural producers and applicators. Keep its yard coordinates and contact details current, especially for remote sites.

Document parcel zoning, lease or landowner permission and the proposed layout separately. The law’s liability limitation has operating and zoning conditions and exceptions; do not treat it as unconditional protection or a substitute for insurance advice. Our beehive insurance guide helps frame questions for the insurer.

If selling honey, classify the processing and sales activity separately from bee-stock inspection. Use the home honey-business guide to prepare that inquiry.

Legal and safety alert: Resolve the actual stock, equipment, location and shipment documents before transport. Maintain inspectable hives and report known disease promptly.

Frequently Asked Questions

How should I compare Virginia nuc and package offers?

Identify whether the purchase contains comb or used equipment, then ask VDACS which entry documents cover that load. Keep the official documents and supplier details with the order.

Does Virginia BeeCheck authorize a backyard apiary?

No. BeeCheck supports communication. Verify the parcel’s rules and permission separately, and check any applicable inspection or movement requirements.
