Berlin Beekeeping Laws: Imkerei Rules & Registration

Berlin beekeeping laws require you to notify the Veterinär- und Lebensmittelaufsicht for the borough where the bees are kept, stating colony numbers and location. Registration does not authorize a balcony, courtyard or roof installation. Property rights, building safety and neighbor impacts remain separate questions.
Contact the borough before acquiring bees and submit its registration form, then confirm the proposed site with the owner or landlord. LAGeSo’s published notice says no current legal reporting duty to Berlin’s disease fund exists while no contribution ordinance is in force; recheck that notice alongside the mandatory borough registration.
Berlin beekeeping obligations compared
| Topic | Requirement or current position | Next step |
|---|---|---|
| Borough registration | Required no later than starting bee keeping | Notify the Veterinäramt for the hive location |
| Fees | Check the borough service and any requested certificates | Budget separately for association cover and site costs |
| Disease fund | LAGeSo reports no current legal reporting duty as of August 2026 | Recheck if an ordinance is introduced |
| Hive numbers and permits | No single balcony allowance established here | Review lease, shared-property and site conditions |
| Setback | No universal Berlin residential distance verified | Plan safe flight routes and protect neighbor use |
| Movement | Health documentation can be required for another location | Consult origin and destination veterinary offices |
Use the Berlin registration service to find the responsible office; the postal address of the beekeeper may differ from the borough containing the apiary.
Imkerei anmelden: register the actual bee location
Section 1a of the Bienenseuchen-Verordnung requires notification by the start of bee keeping. Notify earlier where possible so the borough can explain the form, registration number and local procedures.
Provide accurate colony numbers and the hive site. Report relevant changes and keep the confirmation. Borough guidance, such as Neukölln’s beekeeping page, also explains movements and health records.
An association membership is not a substitute for this notification. An apiary in a community garden still needs an identified person responsible for official contact and management.
Tierseuchenkasse: check the current Berlin notice
Berlin’s fund is now presented as the Tiergesundheitskasse, formerly Tierseuchenkasse. Its LAGeSo reporting page states that no contribution ordinance is currently in force and therefore no statutory reporting duty to the fund applies, with an August 2026 status date.
The notice recommends voluntary reporting and explains that a future ordinance could change the position. Do not copy a compulsory annual payment or registration rule from another German state into a Berlin guide.
This update concerns the fund only. The national bee-disease regulation and borough notification remain applicable.
Health certificates and moving colonies
Neukölln says a Gesundheitsbescheinigung confirming freedom from American foulbrood is needed before moving bees outside the borough. Ask the origin office early enough to arrange the necessary examination and confirm the receiving office’s requirements.
Do not reduce this to a rule applying only when crossing a German state boundary; a move within Berlin can involve a different borough and veterinary office. Check current AFB restriction areas before moving colonies or used equipment.
Maintain the relevant treatment record, often called a Bestandsbuch, and follow the applicable veterinary-medicine directions. A health certificate is a dated document, not an indefinite guarantee that the colony cannot develop disease.
German swarm law: Schwarmrecht, not Schwammrecht
BGB section 961 addresses loss of ownership if the beekeeper does not immediately pursue an escaped swarm or abandons pursuit. Section 962 provides a limited right to enter another person’s land during pursuit and requires compensation for damage.
Sections 963 and 964 address different situations involving merged swarms or entry into another occupied hive. They are not a general permission to enter buildings, dismantle property or perform risky collection.
Notify the occupier and use an experienced collector where appropriate. Do not treat a swarm in a high structure as something that must be reached regardless of access or safety.
Balconies, Altbau courtyards and BGB section 906
BGB section 906 concerns effects on neighboring property and includes qualifications about impairment and local use. It does not give a registered beekeeper unlimited neighbor tolerance.
Use our apartment balcony beehive feasibility checklist to assess space and access, then have the landlord or competent building professional resolve permission and loading. An older Altbau balcony needs an actual assessment of its condition and intended loads.
Plan a water source and a departure route away from shared doors and sitting areas. For persistent defensive behavior, obtain experienced help and use our guide to calming defensive bees in urban courtyards.
Complete borough notification, property permission, site review and any movement documentation before installation.

Frequently asked questions
Where do I register bees in Berlin?
Notify the Veterinär- und Lebensmittelaufsicht for the borough where the bees are kept, with colony numbers and location. The national bee-disease regulation requires notification no later than the start of keeping bees.
Is annual Tierseuchenkasse registration compulsory in Berlin?
The LAGeSo notice checked states that, as of August 2026, no contribution ordinance is in force and there is no current legal reporting duty to Berlin’s disease fund. This does not remove mandatory borough bee registration.
Can I keep a hive on a rented Berlin balcony?
Do not assume so. Review the lease, obtain agreement where required, and assess building loads, working access, neighbor use and flight paths. Bee-health registration does not approve the balcony.
Can I pursue my swarm onto neighboring land?
BGB section 962 provides a limited right to enter another person’s land while pursuing the swarm, with liability for damage. It is not a general right to enter a dwelling or perform unsafe removal work.
