North Carolina protects the keeping of up to five hives, while preserving specified local placement and safety rules. G.S. 106-645, amended in 2024, prevents county bans on owning or possessing five or fewer hives and requires city hive ordinances to permit up to five on a single parcel.

Ask your city or county for the current ordinance and submit a proposed layout. Verify private property permission as well, then contact NCDA&CS before selling bees or arranging an interstate purchase. The address-level checklist helps identify the responsible offices.

What the Five-Hive Protection Covers

City ordinances can regulate hive placement and setbacks, require ground placement or a securely anchored stand, and address abandoned or unsafe hives. The statute allows a city to permit an anchored roof installation; it does not approve every roof by itself.

QuestionWhat to verifyUseful record
May I keep the proposed number?State protection and the current local ordinanceHive count and parcel identifier
Where may I place them?Applicable setbacks, mounting and access conditionsA measured site plan
May I sell bees?NCDA permit procedure or an applicable exceptionApproval and seller records
How will spray notifications reach me?The purpose and effective date of each notification systemAccurate yard coordinates and monitored contact details

A lease, HOA agreement or shared-roof arrangement presents a separate property-permission question. Record the answer before purchasing equipment for a place you may not control. For a roof proposal, also work through the rooftop setup checklist.

Selling Bees and Buying Inspected Stock

NCDA’s bee-sale procedure requires a current origin-state health certificate, completed application, signed compliance agreement and a $25 nonrefundable fee. It directs North Carolina producers and resellers of bees on comb to arrange NCDA inspection before distribution.

The Act lists exceptions for fewer than 10 hives sold in a calendar year, a one-time going-out-of-business sale of fewer than 50 hives, and renting bees for pollination or moving them to gather honey. Describe the transaction to NCDA before relying on an exception, particularly for an out-of-state supplier or sales of queens or packages. A hive-count exception should not be casually converted into a count of individual queens.

Keep the supplier’s approval and shipment documents with your purchase. Ask who will arrange the destination’s movement requirements rather than assuming a sales permit answers every transport question.

Two Distinct Pesticide-Notification Systems

NCDA’s June 2026 BeeCheck explanation describes a voluntary mapping and communication system, rather than a regulatory approval.

The separate 2026 apiary registration form concerns notification of intended aerial application of bee-toxic pesticides within one mile. It requires a separate form and $10 for each yard, and says registration becomes effective five days after the beginning of the next quarter. Filing today does not establish immediate coverage.

Maintain an accurate contact and location record. Discuss a workable response plan with a remote yard’s landowner so access, timing and notification responsibilities are clear.

Legal and safety alert: Five-hive protection does not resolve every placement, property or bee-health question. Obtain the applicable requirements before installing, importing or selling colonies.

Frequently Asked Questions

What should I send my North Carolina city before installing bees?

Send the parcel address, hive count and a layout showing entrances, boundaries and access. Request the current ordinance and a written explanation of the requirements that apply to your proposal.

Should I use BeeCheck or the NCDA apiary form?

Compare their purposes and coverage before choosing. Keep the communication-map record separate from any agency filing, and confirm when a submitted registration becomes effective.
